A qualifying foreign person or juristic person may acquire a condominium unit only under the Condominium Act routes and within the statutory foreign-ownership limit. The aggregate area of units held by qualifying foreign owners must not exceed 49% of the total area of all units in the condominium at the relevant registration point, subject to the Act. Obtain a current certificate from the condominium juristic person and confirm eligibility and required funds evidence with the Land Office before signing or remitting money.
Common fees, sinking funds, voting, meeting thresholds, house rules, rental restrictions, arrears and transfer documents are building- and fact-specific. Review the registered condominium regulations, juristic-person records, financial statements, resolutions, insurance, pending disputes and the exact debt and quota certificates with independent counsel.
