Can a foreigner own land?
Foreign ownership of land is generally restricted. Narrow statutory or promoted-project routes have different applicants, purposes, approvals and continuing conditions. Do not use nominees. Obtain transaction-specific Department of Lands or BOI confirmation and Thai legal advice.
What is the condominium foreign-ownership quota?
The aggregate area of units held by qualifying foreign owners must not exceed 49% of the total area of all units in the condominium at the relevant registration point, subject to the Condominium Act. Obtain a current juristic-person certificate and Land Office confirmation before signing or remitting money.
Can a lease renew automatically?
A renewal promise is not the same as a presently registered additional term. Obtain Thai advice on enforceability, form and registration for the specific property and drafted rights.
Who pays property fees and taxes?
Legal liability and contractual allocation are separate. Obtain a Land Office calculation and qualified Thai tax advice for the actual instrument, parties, use and transaction date.
Can a foreigner rent property in Thailand?
A foreign national may enter a rental contract, but lawful use, duration, registration, immigration reporting, condominium rules and any short-stay operation must be checked separately. Verify lessor authority, contract terms and whether OCPB controlled-contract protections apply.
What should due diligence cover?
The scope depends on the property and transaction. Independent Thai legal, Land Office, survey and engineering checks should be defined in writing, with records checked, dates, limitations and unresolved items.
